We are Rio, a company registered in Germany, Düsseldorf, North Rhine-Westphalia. Please read these Terms of Use carefully before using our website and services. By creating an account or using Rio, you agree to be bound by these Terms. If you don't agree, don't use Rio.

1. About Rio

The Personal Tolerance List by Rio is an online tool for people with food intolerances. It brings together information about 400+ foods and 7 common trigger chemicals - histamine, FODMAPs, salicylates, oxalates, sulfur, lactose, and gluten - in one place. The tool helps identify patterns between reactions and specific foods based on each person's unique responses.

What Rio does:

• Provides information about food chemicals

• Allows you to mark foods based on your personal experiences

What Rio does NOT do: 2. Eligibility

• Diagnose medical conditions

• Provide medical advice or treatment

• Replace consultation with healthcare professionals

• Guarantee any health outcomes

2. Eligibility

You must be at least 18 years old to use Rio. If you're under 18, you may only use Rio with the involvement and consent of a parent or legal guardian.

By using Rio, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.


3. Your Account

Registration: To use Rio, you must provide a valid email address. We use passwordless authentication - each time you log in, we send a unique one-time password (OTP) to your email. One-time passwords are valid for a limited time and can only be used once.

Account security: You are solely responsible for:

• Maintaining the security of your email account

• All activities that occur under your account

• Not sharing one-time passwords with others

• Notifying us immediately of any unauthorized access

Email access: Since we use email-based authentication, you must have access to your registered email address to log in. If you lose access to your email, contact us at hello@riofoodplan.com for assistance.

Account accuracy: You agree to provide an accurate, current email address and keep it updated.

Personal use only: Your account is personal and non-transferable. You may not share your one-time passwords or allow others to access your account.


4. Payment Terms

One-time purchase: Access to Rio requires a one-time payment. Pricing is displayed at the time of purchase and may be subject to applicable taxes.

Payment processing: Payments are processed securely through our third-party payment processor, Lemon Squeezy. We do not store your credit card information. By making a purchase, you agree to Lemon Squeezy's terms and conditions.

Currency: All prices are in USD.

Return Policy: Due to the digital nature of our product, all sales are final. Once access to the Personal Tolerance List has been granted, refunds cannot be issued. If you experience technical issues preventing access to the product, please contact us at hello@riofoodplan.com and we will work to resolve the issue.


5. Permitted Use

You may use Rio for lawful, personal, non-commercial purposes only.

You may:

• Access and use Rio's features to track your food tolerance

• Create, view, and modify your personal tolerance markers and notes

• Contact us with questions or support requests

You may NOT:

• Use Rio for any unlawful purpose or in violation of these Terms

• Attempt to reverse engineer, decompile, or extract source code

• Use automated tools (bots, scrapers, crawlers) to access or extract data

• Resell, sublicense, or commercially exploit the service

• Interfere with or disrupt the service or servers

• Impersonate others or provide false information

• Upload malicious code, viruses, or harmful content

• Violate any applicable laws or regulations

6. Medical Disclaimer and Assumption of Risk:

Not medical advice. Rio does not provide medical or health advice. The information is for general education only and does not replace professional medical guidance. If you have a medical condition, are pregnant, have food allergies or intolerances, take prescription drugs, or follow a special diet, talk to your doctor before using the Personal Tolerance List. If Rio's information differs from your doctor's advice, follow your doctor's advice.

If you have anaphylaxis risk or severe health conditions, Rio is not appropriate for self-management. You must work directly with medical professionals.

Your responsibility: You acknowledge and agree that:

• You are solely responsible for any dietary decisions you make

• You assume all risks associated with using information from Rio

• You will not rely solely on Rio for managing health conditions

• You understand that food intolerances can be serious and require professional medical evaluation

7. Your Data and Content

Your markers and notes: You own the tolerance markers and notes you create in Rio. We store them to provide the service to you.

Export your data: Request an export by contacting us at hello@riofoodplan.com . We'll provide it in CSV or PDF format within 30 days.

Delete your data: You can delete your account and all data anytime at https://app.riofoodplan.com/account. Your data will be immediately removed from our active systems.

Backup retention: Deleted data may remain in our backup systems for a reasonable period (typically up to 90 days) as part of our standard data protection and disaster recovery procedures, after which it will be permanently removed.

8. Privacy and Data Protection

Privacy Policy: Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

Health data: Information about your food tolerance, reactions, and notes is considered sensitive health data under GDPR and other privacy laws. We treat this data with appropriate security measures.

Data storage location: Your personal data is stored on servers located within the European Union. We do not transfer your data outside the EU/EEA.

Third-party services: We use third-party services (Google Analytics, Lemon Squeezy, hosting providers) that may process your data. See our Privacy Policy for details.

Your rights under GDPR (EU/EEA residents):

• Access to your personal data

• Deletion of your data

• Data portability

• Objection to certain processing

• Withdrawal of consent

Legal basis for processing (GDPR):

• Performance of contract: To provide Rio services you've purchased

We do not sell or share your personal information as defined by the California Consumer Privacy Act. You have the right to opt-out of any future sale or sharing. We do not discriminate against users who exercise their CCPA rights.

• Right to opt-out of sale or sharing (we do not sell/share)

• Right to non-discrimination for exercising your rights

If you reside in Colorado, Connecticut, Virginia, Utah, Montana, Oregon, Texas, or other states with comprehensive privacy laws, you may have additional rights regarding your personal information. These may include rights to access, delete, correct, or opt-out of certain data processing activities.

Exercising your rights: To exercise any of these rights, contact us at hello@riofoodplan.com. We will respond within 25 days (or sooner as required by law).

Marketing communications:

If you opt in to receive marketing emails during registration:

• You consent to receive product updates, tips, and promotional emails

• You can unsubscribe anytime via the "Unsubscribe" link in emails

• US users: We comply with CAN-SPAM Act

• EU users: We rely on your explicit consent (GDPR Article 6(1)(a))

We never sell your email address to third parties.

Data retention: We retain your data as long as your account is active. After account deletion, we will delete or anonymize your data within 90 days, except where required for legal, accounting, or security purposes.

9. Intellectual Property

Our ownership: Rio and all its content, features, and functionality - including but not limited to text, graphics, logos, icons, images, software, and data compilations - are owned by us and protected by international copyright, trademark, and other intellectual property laws.

Our trademarks: "Rio" and associated logos are our trademarks. You may not use them without our prior written permission.

Food database: The information about food chemicals and nutrients in our database is compiled from various sources. While we strive for accuracy, we make no warranties about its completeness or suitability for any particular purpose.

Restrictions: You may not:

• Copy, modify, distribute, or create derivative works from Rio

• Remove or alter any copyright, trademark, or proprietary notices

• Use any of our intellectual property without permission

10. Service Availability and Changes

Service access: We strive to provide reliable access to Rio but do not guarantee uninterrupted or error-free service.

Maintenance and downtime: We may temporarily suspend access for maintenance, updates, or technical issues. We'll provide notice when reasonably possible.

Service modifications: We reserve the right to:

• Modify, update, or discontinue features of Rio at any time

• Change pricing for future purchases (existing purchases unaffected)

• Implement usage limits or restrictions

Significant changes: For major changes affecting your use of Rio, we'll provide reasonable notice via email or through the service.

No warranties: Rio is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

No indirect damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Service interruptions or delays

• Unauthorized access to your account or data

Maximum liability cap: Our total liability to you for all claims arising from or related to Rio shall not exceed the amount you paid for the service in the 12 months preceding the claim.

Health-related disclaimer: We are not liable for any health outcomes, medical consequences, allergic reactions, or other physical or mental health effects arising from:

• Your use of information from Rio

• Dietary changes you make based on Rio

Acknowledgment: You acknowledge that this limitation of liability is a fundamental element of the agreement between you and us, and that we would not provide Rio without these limitations.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rio, its owners, employees, contractors, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of Rio

• Your violation of these Terms

• Your violation of any rights of third parties

• Your Content or any content you submit

• Health outcomes or consequences from dietary decisions you make

• Any negligent or wrongful conduct by you

This indemnification obligation survives termination of these Terms and your use of Rio.

13. Termination

Your right to terminate: You may stop using Rio at any time by:

• Closing your browser and not returning to the service

• Deleting your data and account (see Section 14)

Our right to terminate: We may suspend or terminate your access to Rio immediately, with or without notice, if:

• You violate these Terms

• You engage in fraudulent or illegal activity

• Your use disrupts the service or harms other users

• Required by law or legal process

• We discontinue Rio (with reasonable notice when possible)

Effect of termination: Upon termination:

• Your right to access and use Rio immediately ends

• You remain liable for any obligations accrued before termination

• Sections that by their nature should survive (liability, indemnification, disputes, etc.) remain in effect

• We may delete Your Content in accordance with our data retention policy

14. Account and Data Deletion

How to delete: You can delete your account and all data at any time through your account settings at https://app.riofoodplan.com/personal-tolerance-list. Your account and data will be immediately deleted from our active systems.

Backup retention: Deleted data may remain in our backup systems for a reasonable period (typically up to 90 days) as part of our standard data protection and disaster recovery procedures, after which it will be permanently removed.

Legal retention: We may retain certain data longer only where required for:

• Legal obligations (tax records, transaction history)

• Fraud prevention and security

• Resolving disputes or enforcing agreements

Irreversible: Account deletion is permanent and cannot be undone. We cannot recover your data after deletion.

15. Changes to These Terms

Our right to modify: We may update these Terms from time to time to reflect changes in our service or business practices, legal or regulatory requirements, security or technical needs

Notice of changes: For material changes to these Terms, we will update the "Last updated" date at the top and display a prominent notice on Rio when you next log in. By continuing to use Rio after changes take effect, you accept the updated Terms.

16. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Rio shall be subject to the exclusive jurisdiction of the courts of Düsseldorf, Germany.

Before initiating formal proceedings, you agree to first contact us at hello@riofoodplan.com to attempt to resolve the dispute informally.

To the extent permitted by law, all disputes must be resolved on an individual basis. You may not bring claims as part of a class action, consolidated proceeding, or representative action.

17. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding Rio and supersede all prior agreements.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or technical failures.

These Terms are written in English. Any translated versions are provided for convenience only. In case of conflict, the English version prevails.
