Terms of Service

We are Rio, made by Anastasiia Kirzhanova, a sole proprietor (Einzelunternehmerin) operating under the business name Soba Apps in Berlin, Germany.
Please read these Terms of Service carefully before using our app. By creating an account or using Rio, you agree to be bound by these Terms. If you don't agree, don't use Rio.
1. About Rio
Rio is a mobile app for people with food intolerances. It brings together information about 500+ foods and 7 common trigger chemicals: histamine, FODMAPs, salicylates, oxalates, sulfur, lactose, and gluten. Rio helps you spot patterns between your reactions and specific foods, based on your unique answers.
What Rio does:
- Provides educational information about food chemicals
- Lets you take a quiz to get a personalised tolerance profile
- Generates a colour-coded food list based on your settings
- Lets you adjust tolerance levels and mark foods based on your personal experience
What Rio does NOT do:
- Diagnose medical conditions
- Provide medical advice or treatment
- Replace consultation with healthcare professionals
- Guarantee any health outcomes
2. Eligibility
You must be at least 16 years old to use Rio.
By using Rio, you confirm that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Your Account
Registration:
You can sign up using Sign in with Apple, Sign in with Google, or email and password. When you sign in with Apple or Google, their terms and privacy policies also apply to that sign-in.
Account security:
You are responsible for:
- Keeping your password (or your Apple / Google account) secure
- All activity that happens under your account
- Notifying us immediately of any unauthorised access at hello@riofoodplan.com
Account accuracy:
You agree to provide an accurate email address and keep it current.
Personal use only:
Your account is personal and non-transferable. Don't share it.
4. Payments
Rio is currently free.
If we introduce in-app purchases or paid features in the future, we'll update these Terms first. Any payments will go through the Apple App Store. We don't handle payment details directly.
5. Permitted Use
You may use Rio for lawful, personal, non-commercial purposes only.
You may:
- Use Rio's features to track your food tolerance
- Create, view, and modify your personal markers and notes
- Contact us with questions or feedback
You may NOT:
- Use Rio for any unlawful purpose or in violation of these Terms
- Reverse engineer, decompile, or try to extract source code
- Use automated tools (bots, scrapers, crawlers) to access or extract data
- Resell, sublicense, or commercially exploit Rio
- Use Rio's content for restaurants, catering, meal delivery, nutritional consulting, or any other commercial activity without our written permission
- Build a competing product using Rio's data or content
- Interfere with or disrupt the service
- Impersonate others or provide false information
- Upload viruses, malware, or harmful content
- Violate any applicable laws or regulations
If you do any of this, we may suspend or close your account.
6. Our Content
Everything in Rio belongs to us or is licensed to us. This includes the design, code, food database, illustrations, text, and the names "Rio" and "Soba Apps". It's protected by copyright and trademark law.
You can use Rio for your own personal use. You can download a copy of your own data and tolerance list. Everything else (copying, redistributing, modifying, publicly displaying our content) needs our written permission.

7. Copyright Notice
If you believe any content in Rio infringes your copyright, please contact us at hello@riofoodplan.com with:
- A description of the work you claim is infringed
- Where it appears in Rio
- Proof that you own the rights
- Your contact information
We'll review the claim and respond within a reasonable time.
8. Apple App Store and Mobile App Licence
Mobile App Licence
If you got Rio from the Apple App Store, we grant you a revocable, non-exclusive, non-transferable licence to install and use the App on your personal devices, in accordance with the usage rules of the App Store.
You may not:
- Decompile, reverse engineer, disassemble, or try to extract the source code of the App
- Modify, adapt, or create derivative works from the App
- Use the App in violation of any law
- Remove or alter any copyright, trademark, or proprietary notices
- Use the App for revenue-generating or commercial purposes outside your personal use
- Make the App available over a network for use by multiple devices or users at the same time
- Use the App to create a competing product, service, or software
- Use any of our proprietary information or interfaces in other applications
- Reverse engineer or adapt the App's software
Apple as a Third Party
These Terms are between you and us only, not Apple Inc. Apple doesn't provide support for Rio and isn't responsible for any claims about it (including warranty, product liability, regulatory, or consumer protection claims).
You acknowledge that Apple Inc. is a third-party beneficiary of this Mobile App Licence, and Apple has the right to enforce its terms against you.
You confirm that you're not located in a country under US embargo or on a US restricted-parties list (required by Apple).
9. Service Availability and Changes
Service access:
We strive to provide reliable access to Rio but don't guarantee uninterrupted or error-free service.
Maintenance and downtime:
We may temporarily suspend access for maintenance, updates, or technical issues. We'll give notice when reasonably possible.
Service modifications:
We may modify, update, or discontinue features of Rio at any time. For major changes affecting your use of Rio, we'll provide reasonable notice in the app or by email.
No warranties:
Rio is provided "as is" and "as available" without warranties of any kind, either express or implied.
10. Privacy
How we collect, use, and protect your personal data is described in our Privacy Policy.
Hosting location.
Rio's services are hosted in the European Union. If you access Rio from outside the European Economic Area (EEA), your data is transferred to and processed in the EU. By using Rio, you consent to this transfer.

11. Health Data and Regulatory Framework
Rio is based in the European Union and processes your personal data under the General Data Protection Regulation (GDPR). Your health-related information (quiz answers about symptoms and reactions) is treated as a special category of personal data under GDPR Article 9 and is processed only with your explicit consent.
Rio is not subject to US healthcare regulations such as HIPAA for now. Rio is a consumer educational tool, not a medical service.
If you require a HIPAA-compliant tool to manage protected health information, Rio is not the right tool for you. Please consult a US-based healthcare professional or use a HIPAA-compliant medical service.
12. About the Food Database
Rio's food database is built from publicly available scientific research on food intolerances and food chemistry.
A few things to keep in mind:
- People react to foods differently. Your personal tolerance may be different from what Rio shows
- The database is an educational reference, not a guarantee
- Rio doesn't know about your medications, conditions, or interactions
To the extent permitted by law, we're not liable for health consequences from dietary decisions you make based on Rio.
13. Electronic Communications and Signatures
By tapping "I agree" and using Rio, you accept these Terms in electronic form. We may send notices, updates, and other communications electronically (in-app or by email), and these count as valid written communication under applicable law. You agree to receive communications from us electronically.
14. Termination
Your right to terminate:
You can stop using Rio at any time by deleting your account.
Our right to terminate:
We may suspend or terminate your access to Rio if:
- You violate these Terms
- You use Rio for fraudulent or illegal activity
- Your use disrupts the service or harms other users
- Required by law
- We discontinue Rio (with reasonable notice)
Except in cases of serious violations or illegal activity, we'll give you reasonable notice and a chance to fix the problem first.
If Rio shuts down:
We'll give you at least 30 days' notice and let you export your data first.
Your statutory rights as a consumer are not affected.
15. Our Liability
We provide Rio "as is". We do our best to make it work well, but we can't promise it will always be available, accurate, or error-free.
To the extent permitted by law, we're not liable for:
- Indirect or consequential damages
- Lost data or lost profits
- Health consequences from your dietary decisions
This doesn't affect any rights you have under mandatory consumer protection law in your country.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes in our service, business practices, legal requirements, or technical needs.
For material changes, we'll update the "Last updated" date and let you know in the app or by email at least 30 days before the changes take effect. Your continued use of Rio after that means you accept the updated Terms.
17. Applicable Law and Courts
These Terms are governed by German law, excluding conflict-of-law principles and the UN Convention on Contracts for the International Sale of Goods (CISG).
If you're a consumer in the EU, you also have the mandatory protections of the law of your country of residence. Those can't be waived.
Before formal proceedings, please contact us at hello@riofoodplan.com to try to resolve the dispute informally.
The place of jurisdiction is Berlin, Germany. If you're a consumer in the EU, you can also bring proceedings in the courts of your country of residence.
The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr. We're not obliged to and don't participate in dispute resolution proceedings before a consumer arbitration board.
18. For Users in the United States
Rio is available to users in the United States. If you are a US resident, you may have additional rights under your state's privacy laws, including the California Consumer Privacy Act (CCPA / CPRA), Washington's My Health My Data Act (MHMDA), and similar laws in Connecticut, Virginia, Colorado, Texas, Utah, Oregon, Montana, and other states. These rights typically include the ability to access, delete, correct, or limit our use of your personal information.

19. General Provisions
These Terms (together with the Privacy Policy) are the entire agreement between you and us about Rio.
If any provision of these Terms is found to be unenforceable, the rest will remain in full force and effect.
If we don't enforce a provision right away, that doesn't mean we've given up the right to enforce it later.
We may transfer our rights and obligations under these Terms to another business (for example, if we sell Rio). Your rights as a user will stay the same.
These Terms are written in English. Any translated versions are provided for convenience only. In case of conflict, the English version prevails.
